CLUB TREIGN TERMS AND CONDITIONS
- By signing up for a membership at CLUB TREIGN or by making use of any CLUB TREIGN facilities, you agree to abide by these Terms and Conditions. We thus encourage you to read and familiarise yourself with these Terms before you agree to become a Member. These Terms and Conditions are subject to updates;the member must review them periodically. Should you require any assistance or clarification on theTerms and Conditions as outlined herein, do not hesitate to contact us by visiting CLUB TREIGN or by accessing our “contact us” page within our website.
- The “Company” means BORCAM Limited of “The Penthouse, Sant’antnin Block A, Triq San AntonAbbati, 123 Mosta” bearing company registration number C 105688, or any of its successors in title, which Company is registered under the Laws of Malta. The company’s VAT Number is MT 30542429
- “Member” means the person named in the Sign-up form and the
- “Members” means the CLUB TREIGN Member in the plural (which may at times be used interchangeablywith ‘Member’), which persons would have each filled in a Signup form and subscribed to a Membership.
- “Membership” means the membership of clustering, depending on the Member subscription, in accordance with the Terms and Conditions outlined herein.
- “Membership Dues” means the fees or dues which are to be honoured by each Member in consideration of the Membership opted for by the Members.
- “Membership Period” means the length of time for which the respective membership shall remain active,depending on the Membership opted for by the respective
- “CLUB TREIGN” means the gym located at level B2, Mercury Shopping District, Mercury House, St. George’s Road, St Julians, STJ 3202, the facilities ancilliary thereto including but not limited to the showers and changing rooms and other common areas, or any other club operating under the same namein the Maltese
- “CLUB TREIGN Polices” means the general rules and protocols which are outlined in point number 11 below and which apply to all Members of CLUB TREIGN.
- “CLUB TREIGN Website” means “< https://clubtreign.com>”
- This agreement will become binding on you and the Company when your membership application has been accepted, at which point a contract will exist between you and the

CLUB TREIGN Policies:
- Appropriate gym wear must be worn at all times:
- Members seeking guidance on suitable attire may consult a representative of the Company, who reserves the right to request that members leave the premises or certain areas if their attire is deemed inappropriate Constant use of towels is mandatory at all times and in the absence of this, Members may be refused entry.
- Outdoor or dirty clothing is strictly prohibited and not
- Appropriate, clean exercise attire and footwear must be worn while using the clubTRIEGN Facilities.
- In the event that Members are seen without a towel at unmanned hours, they may be scolded and/or refused entry by way of suspension of membership the next time they try to enter (this is at the sole discretion of the Company)
- members are allowed to bring their own towels or may rent or buy towels from CLUB TREIGN (differing rates of rentals are applicable to differing memberships)
- All equipment used must be returned to its original place after their use
- If any cleanliness or maintenance issues are observed, such as spills, broken equipment, or unsanitary conditions in changing rooms or any other common area ancilliary to the CLUB TRIEGN facilities or bathrooms, please report them promptly to the Company or any of its representatives ASAP and this either rin person or through the CLUB TREIGN website (“contact us” portal).
- The Company aims to make CLUB TREIGN a welcoming and enjoyable environment for all members. Members are expected to uphold standards of conduct that respect the rights and comfort of others. The following guidelines are to be followed to ensure a positive experience for everyone:
- Smoking is strictly prohibited within CLUB TREIGN facilities or any other facility within Mercury ancillary to CLUB TREIGN.
- Respectful Communication: Members should maintain a moderate tone and conduct themselves with courtesy. The use of offensive, loud, or abusive language is Disruptive behaviours, such as shouting or aggressive actions, are unacceptable and may lead to consequences.
- Interpersonal Conduct: Acts of threatening behavior, harassment, or inappropriate interactions with other members, guests, or staff are strictly prohibited. Members should interact in a manner that fosters safety and respect.
- Substance Prohibition: Bringing, using, or being under the influence of illegal substances is not permitted anywhere within CLUB TREIGN. This policy is strictly enforced to ensure the health and safety of all
- Alcohol Restrictions: Alcohol is not allowed on the premises, and members must not enter CLUB TREIGN while intoxicated. This rule is in place to maintain a safe and focused environment conducive to fitness and well-being.
- All equipment/machines must be wiped down and properly disinfected after

- Sounds from personal mobile phone/s or any other device/s shall be accessed by the respectiveMember making use of mobile phone/s or any other device/s.
- No animals are allowed within CLUB TREIGN or any of its facilities and/or premises.
- Memberships shall be made active once the Membership Dues have been paid in full and once the Companyhas duly accepted the Member, which acceptance shall be at the full and sole discretion of the Company and/or any of its representatives.
- Membership is available to those 18 years of age and However, individuals under 18 may apply for Membership subject to producing written parental consent and any additional requirements the Company may request from time to time, which requirements shall include but not be limited to the procurement of acopy of the parent/s or guardian/s’ identity card or other valid identification document.
16.
Membership Transferability and Change of Status
- Memberships are non-transferable and may only be used by the individual who initially registered.
- Members interested in changing their membership type (e.g., upgrading from Off-Peak to Essential) can submit a request through the CLUB TREIGN Website. Any change in membership type may be subject to a prorated fee adjustment based on the remaining period of the current membership.
- Changes in membership type will be reviewed by CLUB TREIGN management, and adjustmentswill take effect at the beginning of the following billing cycle, if applicable.
- Refund Policy and Special Circumstances All Memberships are non-cancellable and non-refundable,However, in cases of prolonged illness, relocation, or other exceptional circumstances, members may submit an appeal for partial refund consideration.
- appeals must include documentation to support the request (e.g., medical certificate, proof ofrelocation) and will be reviewed by Management, who will decide based on the specific situation.
- Approval of a refund or membership hold remains at the sole discretion of
CLUB TREIGN and is not guaranteed.
- No membership freezing is allowed, subject to exceptional circumstances, in which exceptional circumstances are to be scrutinised by the Management, who has the ultimate and sole discretion in determining whether or, not the circumstance presented to it shall be considered as such.
- appeals must include documentation to support the request (e.g., medical certificate, proof ofrelocation) and will be reviewed by Management, who will decide based on the specific situation.
- Memberships will last until the end of the respective term corresponding to the Membership subscribed to.
- All Membership Dues are to be paid by the Member or Members (as applicable) prior to the commencement and applicability of the Membership Period.
- All Members are to create a Technogym account, which account will allow the respective Member/s to generate a QR code, and each member will also be given a strap/tag/fob, which can be used instead.
- For a Member to accessCLUB TREIGN, they shall scan the QR code at the entrance through theTechnogym In the event that the Member does not have one of the mentioned means available to him and CLUB TREIGN is unmanned in those hours, it is the respective Member that either one means, or the other is accessible to him or herself. The Company hereby waives ANY kind of responsibility in this regard. A charge will apply for any replacement of the Technogym strap/tag/fob.
- It is imperative to note that the Membership shall merely, solely and exclusively be used by the Member who bought the Membership and paid the Membership Dues ONLY. The membership SHALL NOT be loaned orpassed on to anyone A Breach of this condition may lead to immediate termination of the Membershipwithout any possibility of being refunded.
- Members are entitled to use facilities according to the Membership they opt for and according to the description pertaining to it.
25.
Facilities and Equipment:
- All equipment at CLUB TREIGN is regularly inspected, tested, and maintained. However, if any member becomes aware of damaged or defective equipment, they should immediately stop using it and inform a staff member (in person or through the “contact us” portal on the CLUB TREIGN Website.
- CLUB TREIGN and/or the Company reserves the right to withdraw equipment at any time for anyreason, including but not limited to maintenance, repair, or alteration.
- Equipment is not available for reservation at CLUB TREIGN; usage operates on a first-come, first-served basis.
- It is essential for Members to use equipment solely for its intended purpose according to the manufacturer’s guidelines. Misusing equipment can lead to injuries and may damage the equipment, compromising its availability and safety for others.
- Members should seek guidance or read the instructions before using any unfamiliar equipment.
- Equipment and facilities provided by CLUB TREIGN must only be used appropriately, andmembers must not engage in any activities that pose a health and safety risk to themselves or others.
- To respect the shared nature of the facilities, members should limit their usage of popularequipment, especially during peak hours, to ensure all members have an opportunity to use TheCompany or any of its representatives may request that equipment be made available if a member’s usage exceeds a reasonable duration, particularly if others are waiting. This policy helps ensure a fair experience for everyone.
- For safety, members should follow the posted guidelines and instructions for equipment use and incorporate proper warm-up and cool-down routines to minimize the risk of injury.
- Members are expected to handle all gym equipment with care and adhere to the established guidelines for use. If equipment is damaged due to negligence or misuse, CLUB TREIGNreserves the right to hold the responsible member accountable. This may include financialresponsibility for repairs or replacements and potential suspension of gym All members are encouraged to report any incidents of misuse or accidental damage to a staff member immediately to help maintain a safe and welcoming environment for all users.

Personal Belongings and Locker Use:
- Lockers are available to Members (not exclusively) subject to availability and on a first-come-first-serve basis.
- CLUB TREIGN advises all members to avoid storing valuables in the lockers, as the Company is not liable for any loss, theft, or damage to personal belongings stored on the premises.
- Members are encouraged to bring minimal personal items to the gym to mitigate any risks of loss.
- Lockers are available for use during the member’s workout and must be emptied before Any belongings left overnight may be removed at the discretion of CLUB TREIGN staff.
- Lockers are provided solely for storing gym attire, toiletries, and the clothing members arrive in. Storing any other items in these lockers is strictly Members are advised that whilelockers are available, the Company cannot guarantee protection against theft or damage to personal belongings and accepts no liability for such matters.
- Members must empty their locker before leaving CLUB
- If the Company or any other person in charge of or who maintains the common areas where the lockers are located suspects that a locker is being misused or has not been emptied, it reserves the right to open the locker (using force if necessary) to inspect and remove any unauthorised or remaining Since the locker is in a common area, such items cannot be automatically allocated to a specific CLUB TREIGN member.
26.
Media Usage and Social Media:
The Company understands that members may wish to document their fitness journey through photos and videos. Members are requested to follow these guidelines when recording or taking pictures, as well as when sharing media on social platforms:
- When capturing images or videos, members should first make an effort to ensure no other individuals appear in the frame.
- Absolutely no footage should be taken within the common areas, pertaining to the CLUB TREIGNfacilities and/or premises, especially and most importantly within the changing rooms and/or bathrooms.
- If it is impossible to avoid including others in the frame, members must consider others’ privacy andobtain consent before recording or taking pictures that include them, even if they appear in the background.
- Should members choose to share footage taken at CLUB TREIGN (whether on social media or elsewhere), they are expected to respect the privacy of others. Members must not post or tag anyonewithout explicit consent and should blur or block out any individuals in the background of their images or videos.
27.
Health and Safety:
- Members are responsible for their own state of health, physical condition, and well-being at all Without prejudice to the aforementioned. Hence, should any Member suffer from any health condition, they are solely responsible for ensuring that it is managed and that it will not hinder their ability to exercise. By purchasing a Membership, they confirm that they are fit for exercise and have discussed their exercise plan with the health professional overseeing their care.
- Members acknowledge that the use of equipment provided in the CLUB TREIGN facilitiesinvolves vigorous physical exercise, which may strain their cardiovascular system and other parts of their body. Members understand that such vigorous exercise can be hazardous and voluntarily use the Gym facilities CLUB TREIGN facilities and equipment with awareness of the associated risks and the importance of seeking medical advice prior to using the CLUB TREIGN facilities.
- If members have or suspect they may have any medical conditions such as diabetes, heartissues, or unusual blood pressure, or if they are taking significant medical prescriptions, it is essentialfor them to consult their doctor before using CLUB TREIGN’s This ensures thatengaging in physical activity at CLUB TREIGN is safe. Additionally, in such cases, membersare required to provide a medical clearance letter from their General Practitioner (GP).
- Members are strongly advised against participating in strenuous physical activities for which they may be medically unsuited. Before commencing any intense exercise program, it isprudent to undergo a thorough medical examination to determine fitness and Members should be aware that CLUB TREIGN assumes no responsibility for any injuries or health issues that may arise from such activities. Prioritizing safety and confirming medical and physical readiness before engaging in any physical exercise is vital.
- Members have a duty to monitor their physical responses during exercise and to immediately ceaseany activity that causes unusual or prolonged Listening to one’s body is crucial in preventing injuries and ensuring that workouts remain beneficial rather than harmful.
- Members should ensure that they stay hydrated and properly nourished to support their physical exertions at CLUB TREIGN. Neglecting proper nutrition and hydration can lead to serioushealth issues, including dehydration and nutrient deficiencies, which can adversely affect healthand hinder physical performance.
- Members should refrain from using CLUB TREIGN immediately following a heavy meal.
- If members have any medical conditions or are taking any medication that may affect their ability to exercise or use any equipment or facilities provided by CLUB TREIGN, they must inform CLUB TREIGN and comply with any instructions provided as a result.
- Members should not use CLUB TREIGN while under the influence of alcohol or illegal drugs and/or substances.
- Members should only assist another member who is unwell if they are fully qualified to do so. It is important to note that CLUB TREIGN is not responsible for any actions taken in such circumstances, and members may be held liable for the outcomes of their interventions.
- The Member acknowledges and agrees that use of the CLUB TREIGN facilities is thus entirely at their own risk, and under no circumstances shall CLUB TREIGN , the Company, its employees, agents,contractors and/or subcontractors be liable for any loss, personal injury, or damage sustained by the Member while within the Facilities or when using any services provided by CLUB TREIGN and/or its employees agents, contractors and/or subcontractors, whether CLUB TREIGN is manned or unmanned. By accepting these terms and conditions, the Member expressly agrees that participationin any physical activity within the CLUB TREIGN Facilities or other services offered by CLUB TREIGN is voluntary, and the Member knowingly assumes all associated risks, proceeding with membership despite these Furthermore, the Member unconditionally releases CLUB TREIGN and its employees, agents, contractors and/or subcontractors from any and all liability to the maximum extent permitted by law.
- Emergency Contacts and Procedures: In the event of an injury during unmanned hours, members should use their personal device to contact emergency services directly. Emergency contact information is posted prominently throughout the gym. It is advised that members inform CLUBTREIGN via the website’s contact portal about any incidents that require medical assistance to help monitor safety within the facility.
28.
LIABILITY:
- To the fullest extent permitted by applicable law, CLUB TREIGN facilities are made available formember use without any warranties or representations, either express or implied.
- Subject to applicable law, the Company’s maximum aggregate liability under or in connection with a member’s use of or access to CLUB TREIGN and/or these Terms shall be limited to directdamages up to the total membership fees paid by the member to the Company in the calendar yearin which the loss or damage arose.
- Members fully acknowledge, understand, and accept the inherent risks associated with using any ofthe Company’s fitness facilities, which include but are not limited to the incorrect use of equipment, engaging in strenuous activities, potential hazards from weights, and the possibility of collision with equipment or other members. Members acknowledge that such injuries may result from theirown actions or those of others, including actions, omissions, or negligence. While the Companystrives to maintain a safe environment, the use of these facilities inherently involves significant risk. By choosing to participate, members do so voluntarily and assume full responsibility for any resulting harm or injury. Members are responsible for arranging their own insurance in case of injury caused to or by them while using the facilities.
- Members are required to use all equipment solely for its intended purpose as per the manufacturer’s Misuse of equipment can lead to injury and potential damage, for which the responsible member may be liable.
- Members are encouraged to bring any necessary personal protective equipment, such as weightliftinggloves, to enhance During unmanned hours, towels and disinfectant are available for members to use, but they must bring their own personal safety gear as needed.
- The Company is not responsible for any loss or damage resulting from: (a) unforeseeable circumstances; (b) misuse of the facilities or equipment by the member; (c) member breaches of these Terms; or (d) events beyond the Company’s reasonable control.
- The Company accepts no liability for the loss, damage, or theft of money, valuables, or other personal property of Members or guests. Nor does it accept liability arising from acts or omissions by any third parties offering services within the Personal property stored in lockers isstored at the member’s own risk, and the Company assumes no liability for loss or damage to such items.
- Members shall use the Facilities in line with guidance provided by any representative ofCLUB TREIGN and with posted Misuse of the Facilities is prohibited, and each Member will be held accountable for any intentional or negligent damage they may cause. Members are alsorequired to conduct themselves in a respectful and courteous manner, refraining from behavior that may be offensive or disruptive to others. CLUB TREIGN and its staff reserve the right to restrict access at any time to any Member whose behavior is deemed unsafe for other members within the Clubs.
- It shall be the responsibility of any Member and/or parents or guardians of children under 15years of age to supervise their children whilst in the Club premises, if the children under 15were allowed within the CLUB TREIGN
- Indemnity: By using CLUB TREIGN facilities, members agree to indemnify and hold the Company harmless from any claims arising from injuries or damages sustained while using gym equipment,especially during unmanned Members agree to release CLUB TREIGN from liability tothe fullest extent permitted by law.
- TERMINATION:
Membership/s may be terminated should there be any violation of the CLUB TREIGN policy, Terms and Conditions outlined herein and/or for conduct reasonably considered by CLUB TREIGN or the Company to be detrimental to the welfare, good order, health and safety and character of the CLUB TREIGN and/or any of its Members. The Company reserves the right to retain a proportion of the Membership Dues paid by the Member relating to the use of clustering prior to termination and any reasonable cost incurred as a result of the termination or infringement of the policies or any Term and Conditions contained herein.
- Membership grants access solely to the CLUB TREIGN reserves the right to modify, expand, reduce, or discontinue any Facilities, as well as to utilize the Facilities for special events, parties,seminars, tournaments, or other activities as deemed appropriate, with reasonable notice provided where possible. No compensation will be offered for such closures; however. CLUB TREIGN and/or the Company also reserve the right to deny access to individuals who are, or appear to be, under theinfluence of alcohol, narcotics, or any prohibited substances.
- CLUB TREIGN and/or the Company may temporarily withdraw access to parts of the Facilities or any other facility within Mercury ancillary to CLUB TREIGN due to service disruptions, requiredmaintenance, repairs, or Facility Such work will be completed as promptly as possible.No compensation will be provided for these temporary closures.
- No marketing, promotional, or commercial activities shall be conducted within CLUB TREIGNfacilities or their parking areas by Members or third parties at the initiative of the Member without prior written consent from the Company’s directors.
- By signing this form, the Member expressly consents to CLUB TREIGN using and publishing their name, image, and/or videos (which may include the Member’s image) in any of its publications,websites, and social media platforms, as well as in any materials (including written, electronic, and multimedia) for distribution worldwide or online. The Member further acknowledges that once the aforementioned data and media are published on the internet, CLUB TREIGN will have no control over their subsequent use and disclosure.

Opening Hours:
- CLUB TREIGN is open 24 hours a day, 7 days a week, however entrance of each respectiveMember depends on the type of membership purchased by themselves as outlined in the “Membership Types and Fees” section above.
- The Company reserves the right to adjust the opening hours of the facilities. Hours may vary due to operational needs, holidays, or special events. Any changes to opening times will be communicated in advance through the Company’s website, notices posted at reception, and official social media platforms. Members are encouraged to check these sources regularly to plan visits effectively and maximize their membership experience.
36.
Law and Jurisdiction:
- These Terms and Conditions, along with the relationship between Members and the Company (whether contractual or otherwise), shall be governed by and interpreted in accordance with the laws of Malta.
- Members irrevocably agree to submit to the exclusive jurisdiction of the Courts of Malta or any other specialised body designated for specific measures and legal action as per the Laws of Malta, for the resolution of any matters or disputes arising from these Terms and Conditions.
37.
Waiver and Severability:
- The Company’s failure or delay in enforcing any provision of these Terms does not constitute a waiver of its right to enforce that provision in the future.
- If any provision of these Terms is deemed invalid or unenforceable by a court or administrative body of competent jurisdiction, the invalidity or unenforceability of that provision shall not impactthe validity or enforceability of the remaining provisions, which shall continue to be in full force and effect.
38. Assignment:
The Company reserves the right to assign these Terms, along with its rights and obligations under them, toa third party without requiring the Member’s/s’ consent. This may occur in connection with a corporate transaction or under other circumstances as deemed appropriate by the Company.

Entire Agreement and Changes to these Terms and Conditions:
- These Terms and any other documents explicitly referenced herein constitute the complete agreement between the parties and replace all prior discussions, correspondence, negotiations, arrangements, understandings, or agreements regarding this subject matter. Both parties acknowledge that neither has relied on any representation or warranty (whether made innocently ornegligently) not expressly included in these Terms or the referenced documents.
- The Company reserves the right to modify these Terms at any time and will notify members through methods deemed reasonable under the circumstances.
- In the event of any conflict between the current version of these Terms and Conditions and any previous versions, the most recent and updated provisions shall prevail unless explicitly stated otherwise.

Feedback and Complaints:
The Company truly values Member feedback and is committed to ensuring that it is acknowledged.
- Members may submit any complaints, suggestions, or inquiries regarding the use of the Platform by reaching out through any of our available contact channels, namely through the CLUB TREIGN Website.
- All communications will be treated with care and

- Guest Pass Policy
CLUB TREIGN offers guest passes under specific terms:
- Guests are only permitted if a current member accompanies All guests must sign a waiver before using the facilities.
- Guests must adhere to the same rules and policies as members. Any violation by a guest will reflect on the sponsoring member, potentially impacting their membership status.
- Guest passes may be subject to fees, which will vary based on the type of access
- Members are responsible for ensuring that guests are 18 years of age or older, or if younger, haveobtained parental consent as per the guidelines for underage

Lost and Found
- Lost items will be held in the CLUB TREIGN lost and found for a period of
30 days, after which unclaimed items will be discarded or donated.
